RTBLink Advertising Platform · Version 1.1 · Effective Date: August 2026
These Terms and Conditions (“Terms”, “Agreement”) govern access to and use of the RTBLink advertising platform, including all related websites, interfaces, technologies, APIs, tools, services and products provided through the platform.
The services are provided by: AUSHRA Labs s.r.o., Křemenáčová 90/6, Pitkovice, 104 00 Praha 10, Czech Republic. Company Registration Number: 247 75 967 (hereinafter referred to as “RTBLink”, “Company”, “we”, “us” or “our”).
RTBLink operates a digital advertising technology platform providing real-time bidding (“RTB”), programmatic advertising solutions, traffic monetization services, campaign management tools, analytics, tracking technologies and related advertising services connecting advertisers, publishers, affiliates and technology partners worldwide.
By accessing or using the RTBLink platform, creating an account, launching advertising campaigns, integrating traffic sources, or otherwise using any RTBLink service, you (“User”, “you”, “your”) agree to be legally bound by these Terms.
If you do not agree with any provision of these Terms, you must not access or use the RTBLink services.
By registering an account; clicking “Accept”, “Create Account”, “Register” or similar confirmation buttons; entering into a commercial relationship with RTBLink; or using any RTBLink service, you acknowledge that:
a) you have read, understood and accepted these Terms; b) you have legal capacity and authority to enter into this Agreement; c) if you act on behalf of a company or organization, you have full authority to legally bind such entity; d) all information provided to RTBLink is accurate, complete and current.
These Terms constitute a legally binding agreement between you and AUSHRA Labs s.r.o.
You agree that electronic acceptance of these Terms has the same legal effect as a signed written agreement. Electronic records, account activity logs, payment records, campaign settings, API requests and system-generated reports may be used as evidence of transactions and activities performed through the platform.
RTBLink reserves the right to modify these Terms from time to time. Where changes are material, RTBLink may notify users through email, account notifications, platform announcements, or other reasonable communication methods.
Continued use of the platform after publication of updated Terms constitutes acceptance of the revised version. If you do not accept the updated Terms, you must discontinue use of the services.
For purposes of this Agreement, the following definitions apply:
3.1 “Platform” — the RTBLink online advertising technology environment, including websites, dashboards, interfaces, APIs, databases, tracking systems, software, documentation and related infrastructure.
3.2 “Advertiser” — any individual, company or organization using RTBLink services to purchase advertising inventory, launch campaigns, promote products, services, websites, applications or offers.
3.3 “Publisher” — any individual, company or organization providing advertising inventory, websites, applications, traffic sources, audiences or other digital properties through which advertisements may be displayed.
3.4 “Affiliate Partner” — any party promoting advertising offers, products or services through affiliate marketing activities using RTBLink services or traffic sources.
3.5 “Campaign” — any advertising activity created, configured or managed through the Platform, including targeting parameters, budgets, bids, creatives, landing pages and tracking settings.
3.6 “Advertisement” or “Ad” — any advertising material, including but not limited to: banners; native advertisements; push notifications; pop formats; video advertisements; display advertisements; landing pages; promotional content; tracking URLs; creative materials.
3.7 “Creative Materials” — all text, images, videos, logos, trademarks, landing pages, software, promotional materials and other content provided by an Advertiser or Affiliate Partner.
3.8 “Traffic” — digital users, impressions, clicks, visits, conversions or other measurable interactions generated through Publisher inventory, advertising channels or other sources.
3.9 “Conversion” — a measurable action defined by the Advertiser or RTBLink, including but not limited to: registration; purchase; subscription; installation; lead submission; other specified events.
3.10 “RTB Auction” — the automated real-time bidding process where advertising inventory is bought and sold through programmatic technologies based on predefined parameters.
3.11 “API” — application programming interfaces provided by RTBLink enabling automated access to certain platform functionality.
3.12 “Fraudulent Activity” — any activity intended to artificially generate, manipulate, misrepresent or abuse advertising results, including but not limited to: fake clicks; fake impressions; bots; automated traffic; click farms; incentivized traffic where prohibited; fake leads; conversion manipulation; cookie stuffing; domain spoofing; unauthorized redirects; malicious activity.
3.13 “Applicable Law” — all applicable laws, regulations and industry standards relevant to the services, including but not limited to: laws of the Czech Republic; European Union legislation; GDPR; ePrivacy requirements; Digital Services Act; advertising regulations; consumer protection legislation; sanctions and AML regulations.
3.14 “Data Processing Agreement” or “DPA” — the data processing agreement entered into between RTBLink and a User where RTBLink acts as a data processor, governing the processing of personal data on behalf of the User in accordance with Article 28 of the GDPR. The standard RTBLink DPA is available at rtblink.com/dpa.
RTBLink provides technology and infrastructure enabling advertisers and publishers to participate in digital advertising transactions. Services may include: RTB marketplace access; programmatic advertising; campaign management; traffic monetization; audience targeting; optimization tools; reporting and analytics; tracking solutions; API integrations; technical support.
RTBLink will use commercially reasonable efforts to maintain platform availability. However, RTBLink does not guarantee that: the Platform will operate uninterrupted; services will always be error-free; campaigns will achieve specific results; advertisers will receive a specific number of impressions, clicks, conversions or revenue; publishers will generate specific earnings.
Advertising performance depends on many external factors, including market conditions, competition, user behavior, targeting parameters and third-party systems.
Unless expressly agreed in writing, RTBLink does not guarantee: return on investment; profitability; conversion rates; traffic quality beyond agreed compliance standards; ranking or placement; minimum revenue levels.
To use RTBLink services, users must create an account and provide accurate information. Users agree to provide: legal entity information; contact details; payment information; business information; verification documents where required.
RTBLink may perform verification procedures including: Know Your Customer (“KYC”); Know Your Business (“KYB”); identity verification; sanctions screening; fraud prevention checks; business activity verification. RTBLink may request additional documentation at any time.
Failure to provide requested information may result in: limitation of access; suspension; withholding payments; termination of account.
Users are responsible for: maintaining confidentiality of login credentials; protecting API keys; monitoring account activity; preventing unauthorized access.
All actions performed through an account shall be considered actions of the account owner unless proven otherwise.
Advertisers using RTBLink services are solely responsible for the legality, accuracy, quality and compliance of their advertising campaigns, products, services, websites, applications, landing pages and promotional materials.
Advertiser agrees that all campaigns submitted through the Platform shall comply with: these Terms; applicable laws and regulations; advertising standards; intellectual property rights; consumer protection requirements; privacy and data protection requirements.
By submitting a Campaign, Advertiser represents and warrants that: a) it owns or has obtained all necessary rights, licenses, permissions and authorizations required to advertise the promoted products or services; b) all information provided in advertisements is accurate, truthful and not misleading; c) advertising materials do not violate rights of any third party; d) promoted products and services are legally available in the selected jurisdictions; e) landing pages and websites comply with applicable laws and regulations; f) tracking technologies and data collection practices comply with applicable privacy legislation.
Advertiser is solely responsible for all websites, applications, landing pages and digital properties connected with advertising campaigns. Advertiser shall ensure that landing pages: clearly identify the advertiser or business operator where required; provide legally required disclosures; do not contain misleading claims; do not distribute malware or harmful software; comply with consumer protection regulations; respect user privacy rights.
RTBLink is not responsible for the content, operation or legality of Advertiser websites.
Publishers participating in the RTBLink ecosystem must provide legitimate advertising inventory and ensure that traffic supplied to the Platform complies with: these Terms; applicable laws; industry standards; privacy requirements.
Publishers must not generate or provide: automated traffic; bot traffic; fake impressions; fake clicks; manipulated engagement; incentivized traffic unless explicitly approved; traffic generated through prohibited methods; traffic from unauthorized sources.
Publisher represents and warrants that it has all necessary rights to provide advertising inventory, including: ownership or authorization to operate websites/apps; rights to place advertising technologies; compliance with copyright and intellectual property laws.
RTBLink may request information regarding: traffic sources; acquisition methods; websites; applications; audiences; distribution channels. Publisher agrees to provide accurate information upon request.
All advertisements submitted through RTBLink must be: lawful; accurate; transparent; non-deceptive; suitable for the intended audience; compliant with applicable advertising regulations.
RTBLink may reject, remove or suspend advertisements containing or promoting:
Illegal activities — including illegal goods or services, criminal activities, hacking services, malware distribution, phishing, fraudulent schemes.
Harmful or deceptive content — including false claims, misleading statements, fake testimonials, fabricated news, impersonation, deceptive user interfaces, fake system warnings.
Financial and investment restrictions — advertising must not promote fraudulent investment schemes, fake financial services, unauthorized financial products, misleading cryptocurrency offers, or illegal trading platforms. Advertisers promoting regulated financial services must hold all required licenses and approvals.
Medical and health restrictions — advertising must not make unsupported medical claims, guarantee treatment results, promote illegal medicines, or misrepresent health products.
Discriminatory or harmful content — including hate speech, discrimination, extremist propaganda, content promoting violence, harassment.
Malware and security threats — including malware, spyware, ransomware, malicious software, unauthorized browser modifications, deceptive downloads.
Certain industries may require additional review, documentation or approval. Examples include: financial services; cryptocurrency; gambling; betting; healthcare; pharmaceuticals; adult-oriented products; dating services; software downloads; supplements.
RTBLink may request licenses, certificates, compliance documents or proof of authorization. Approval of a vertical does not remove Advertiser’s responsibility for compliance.
Advertisers operating in age-restricted verticals are solely responsible for ensuring that advertising is not directed at minors and that all applicable age verification requirements are met.
Affiliate Partners are responsible for ensuring that promotional methods comply with: applicable laws; advertiser requirements; platform rules; privacy regulations.
Affiliate Partners must not engage in: cookie stuffing; forced clicks; fake leads; fake registrations; misleading promotions; trademark abuse; unauthorized brand usage; cloaking or content masking of any kind; traffic laundering; unauthorized redirects.
Where required by law, affiliates must disclose: commercial relationships; sponsored content; affiliate relationships; advertising nature of communications.
RTBLink uses internal systems, third-party technologies and analytical methods to detect suspicious activity. Such methods may include: traffic analysis; behavioral analysis; device fingerprinting; IP analysis; conversion validation; automated fraud detection systems.
Invalid traffic includes, but is not limited to: bot-generated impressions; automated clicks; artificial conversions; incentivized actions without approval; fake users; manipulated attribution; suspicious traffic patterns.
If RTBLink reasonably suspects fraudulent activity, it may: suspend campaigns; block traffic sources; freeze payments; adjust balances; reject invalid conversions; terminate accounts; cooperate with law enforcement or regulators where required.
RTBLink shall not be liable for losses resulting from fraudulent activity performed by Advertisers, Publishers, Affiliates or third parties.
Advertisers are responsible for: campaign configuration; budgets; bids; targeting; creatives; tracking settings.
RTBLink may provide automated optimization technologies, algorithms or AI-assisted tools. Advertiser acknowledges that: automated systems may make recommendations or adjustments; results are not guaranteed; Advertiser remains responsible for campaign decisions.
RTBLink may modify, pause or restrict campaigns where necessary to: comply with laws; protect users; prevent fraud; maintain platform quality; protect partners.
Advertisers must maintain sufficient funds or approved payment arrangements to use paid services. Applicable pricing may depend on: bidding model; impressions; clicks; conversions; targeting parameters; negotiated commercial terms.
Unless otherwise agreed, RTBLink’s tracking and reporting systems shall be considered the primary source for billing calculations.
Payments may be processed through third-party payment providers. RTBLink is not responsible for: payment processor failures; banking delays; currency conversion fees; third-party transaction charges.
Advertisers are responsible for all applicable taxes, duties and governmental charges arising from their use of RTBLink services, except taxes imposed on RTBLink’s income.
Unauthorized chargebacks or payment reversals may result in: account suspension; recovery actions; withholding of services; additional administrative costs.
Refund requests may be submitted by Advertisers only through official communication channels provided by RTBLink. A refund request must include: account information; payment details; reason for the request; any supporting documentation requested by RTBLink.
Refunds may be considered only for unused account balances that have not been spent on advertising services. Refunds shall not apply to: completed advertising services; delivered impressions, clicks or conversions; fraudulent or invalid traffic-related adjustments; promotional credits or bonuses; amounts subject to contractual disputes.
RTBLink may verify: identity of the account holder; payment ownership; compliance with these Terms; absence of outstanding obligations. Approved refunds may be processed within 30 business days after completion of verification procedures.
RTBLink may refuse refunds where: the account violated these Terms; fraudulent activity occurred; payments were made through unauthorized methods; refund requests are inconsistent with applicable law.
RTBLink processes personal data in accordance with applicable data protection laws, including: Regulation (EU) 2016/679 (“GDPR”); applicable Czech data protection legislation; ePrivacy requirements where applicable. Detailed information regarding personal data processing is provided in the RTBLink Privacy Policy.
Depending on the nature of processing activities, RTBLink may act as: a data controller; a data processor; an independent service provider processing data according to contractual instructions. The applicable role depends on the specific service relationship between RTBLink and the User.
Where RTBLink acts as a data processor on behalf of a User, the parties shall enter into a Data Processing Agreement (DPA) as required by Article 28 of the GDPR. The standard RTBLink DPA is available at rtblink.com/dpa.
Advertisers, Publishers and Affiliates are responsible for ensuring that: they have a lawful basis for collecting and sharing personal data; required user consents are obtained where necessary; tracking technologies comply with applicable laws; privacy notices are provided to end users.
RTBLink may use cookies, pixels, SDKs, tracking technologies and similar tools for: campaign measurement; fraud prevention; analytics; optimization; attribution. Use of such technologies shall comply with applicable privacy requirements.
RTBLink may provide API access enabling users to: manage campaigns; retrieve reports; automate platform operations; integrate third-party systems. API access is provided at RTBLink’s discretion.
Users are responsible for: protecting API keys; preventing unauthorized access; controlling connected applications. API credentials must not be sold, transferred, publicly disclosed or provided to unauthorized third parties.
Any actions performed through API integrations, scripts, automation tools, AI agents or third-party software shall be considered actions performed by the account owner. The account owner remains fully responsible for campaign settings, bids, budgets, traffic decisions and resulting costs or losses.
Where RTBLink provides AI-assisted functionality, users acknowledge that: AI-generated recommendations may not always be accurate; automated decisions require human oversight; RTBLink does not guarantee specific outcomes. Users remain responsible for reviewing and approving campaign activity.
All rights, title and interest in RTBLink software, platform architecture, databases, algorithms, trademarks, logos, documentation and technology remain the exclusive property of AUSHRA Labs s.r.o. or its licensors.
Subject to compliance with these Terms, RTBLink grants users a limited, non-exclusive, non-transferable right to access and use the Platform solely for permitted business purposes.
Users must not: copy or reproduce Platform components; reverse engineer software; attempt to extract source code; modify technology; create competing products based on RTBLink systems.
Users retain ownership of their own advertisements, trademarks, creative materials, websites and business content. By submitting materials to RTBLink, users grant RTBLink a limited license necessary to provide advertising services.
Confidential Information includes any non-public information relating to business operations, pricing, technology, algorithms, campaign data, traffic sources and commercial relationships.
Each party agrees to protect confidential information, use it only for purposes of this Agreement, and prevent unauthorized disclosure.
Confidentiality obligations do not apply to information that: is publicly available; was lawfully known before disclosure; is independently developed; must be disclosed by law or regulatory authority.
RTBLink may immediately suspend or restrict access where it reasonably believes that: these Terms were violated; fraudulent activity occurred; illegal activity is suspected; platform security is threatened; payments are overdue.
RTBLink may terminate an account where: material breach occurs; prohibited activity is detected; required verification documents are not provided; continued cooperation creates legal or reputational risk.
Users may stop using the Platform at any time. Termination does not remove obligations accrued before termination.
Upon termination: access to services may cease; outstanding payments remain payable; confidential obligations survive; fraud investigations may continue.
The User agrees to defend, indemnify and hold harmless AUSHRA Labs s.r.o., RTBLink, its affiliates, employees, partners and representatives from claims, damages, losses, liabilities and expenses arising from: violation of these Terms; unlawful advertising activities; infringement of third-party rights; misuse of the Platform; fraudulent activity; violation of applicable laws.
To the maximum extent permitted by applicable law, RTBLink shall not be liable for: indirect damages; loss of profits; loss of business opportunities; loss of reputation; business interruption; third-party failures; changes in advertising performance.
RTBLink services are provided on an “as available” basis. RTBLink does not guarantee uninterrupted operation, specific campaign results or revenue levels.
Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.
Neither party shall be liable for failure or delay caused by events beyond reasonable control, including natural disasters, war, government actions, internet failures, cyber incidents, telecommunications failures, changes in legislation or other extraordinary circumstances.
The affected party shall notify the other party within a reasonable period where possible.
The relationship between RTBLink and users is that of independent contractors. Nothing in these Terms creates an employment relationship, partnership, joint venture or agency relationship. Neither party has authority to bind the other unless expressly agreed in writing.
Users may not transfer their rights or obligations under these Terms without prior written approval from RTBLink. RTBLink may assign these Terms to affiliates, successors or entities acquiring its business or assets.
In the event of a dispute arising from these Terms, the parties agree to first attempt resolution through good-faith negotiation.
The party raising the dispute must submit a written notice to the other party describing the nature of the dispute and the outcome sought. The parties shall have 30 days from receipt of such notice to reach an agreed resolution.
If the dispute is not resolved within 30 days, either party may refer the matter to mediation before initiating legal proceedings. Mediation shall be conducted by a mutually agreed mediator. If the parties cannot agree on a mediator within 30 days, either party may proceed directly to the courts specified in Section 26.
Nothing in this section prevents either party from seeking urgent injunctive or interim relief from a competent court at any time.
These Terms shall be governed by and interpreted according to the laws of the Czech Republic.
Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of Prague, Czech Republic, unless mandatory applicable law provides otherwise.
These Terms, together with the Privacy Policy, the Data Processing Agreement (where applicable), applicable service agreements and platform rules, constitute the entire agreement between the parties.
If any provision is found invalid or unenforceable, the remaining provisions shall remain effective.
Failure to enforce any provision does not constitute a waiver of future enforcement rights.
